Terms & Conditions
These Terms & Conditions (the “Agreement”) govern your access to and use of the ELVIS OF NAZARETH website (the “Site”) and any content, tools, features, or services made available through the Site (collectively, the “Services”).
1) Acceptance of Terms
By accessing the Site, using any portion of the Site, or using any Services, you agree to be bound by this Agreement. If you do not agree to all terms and conditions, you may not access or use the Site or Services.
2) Modifications to Terms
ELVIS OF NAZARETH may update or modify this Agreement at any time without prior notice. The version posted on the Site is the current version. You are responsible for reviewing this Agreement before using the Site. Continued use of the Site after changes are posted constitutes acceptance of those changes.
3) Use of the Site
The Site may allow users to post offers, advertise, bid, shop online, or engage in other interactive features. You agree that you will not:
Use the Site or Services if you cannot form a legally binding contract, are under 18 years of age, or are temporarily or indefinitely suspended from using the Site or Services
Post items or content in inappropriate categories or areas of the Site
Collect or harvest other users’ personal information without permission
Manipulate prices, interfere with other users’ listings, or otherwise disrupt fair marketplace activity
Post false, inaccurate, misleading, defamatory, unlawful, or libelous content
Take any action that may damage or undermine any rating, review, or reputation system
Introduce malware or harmful code (including worms, viruses, or destructive code), or attempt to compromise the Site’s security or functionality
4) Registration and Account Security
To complete sign-up, you may be required to provide a full legal name, current address, a valid email address, a username, and other information needed to create an account.
You represent that you are at least 18 years old. You are responsible for maintaining the confidentiality of your password and for all activities conducted under your account, including any content uploaded or submitted through your account.
Any information provided by you, or collected by the Site or third parties during your visit, is subject to the ELVIS OF NAZARETH Privacy Policy.
5) Term and Termination
This Agreement remains in effect while you use the Site or Services.
You may terminate your account at any time by following the instructions in the account settings (including any “Termination of Account” option, if available).
ELVIS OF NAZARETH may suspend or terminate your access or membership at any time, with or without notice, for any reason, including for violation of this Agreement. If you are using a paid version of a Service and ELVIS OF NAZARETH terminates your access due to your breach of this Agreement, you are not entitled to a refund of any unused fees.
Certain provisions of this Agreement will remain in effect after termination, including provisions relating to intellectual property, disclaimers, limitation of liability, confidentiality, and dispute resolution.
6) Non-Commercial Use (Members)
If the Site is offered as a social networking or community platform, members may not use the Site or Services in connection with commercial endeavors or ventures, including posting promotional links to other websites, whether competitive or not, unless ELVIS OF NAZARETH expressly authorizes such activity in writing.
Organizations, companies, and other business entities may not register as members or use the Site as “Members” unless expressly permitted by ELVIS OF NAZARETH.
7) Links and Framing
Illegal and/or unauthorized use of the Services, including unauthorized framing of or linking to the Site, may be investigated, and ELVIS OF NAZARETH may take appropriate legal action.
Links to the Site may be permitted provided that you comply with all of the following:
You post links only in permitted areas (such as a forum, chat, or message board), where applicable
You do not remove or obscure advertisements, copyright notices, or other notices displayed on the Site
Your link does not state or imply sponsorship or endorsement by ELVIS OF NAZARETH
You immediately remove links upon written notice from ELVIS OF NAZARETH
You are responsible for checking any copyright or usage notices on the page you wish to link to, as third-party content providers may maintain separate rules regarding direct links to their content.
8) Disclaimer of Warranties
The Site and Services (including all information, content, and materials) are provided on an “as is” and “as available” basis.
ELVIS OF NAZARETH makes no express or implied warranties or representations regarding the Site, the Services, or any products sold through the Site, including warranties of merchantability, fitness for a particular purpose, non-infringement, or any implied warranties arising out of course of dealing or trade usage.
ELVIS OF NAZARETH does not warrant that operation of the Site will be uninterrupted, secure, or error-free.
9) Limitation of Liability
To the fullest extent permitted by law, ELVIS OF NAZARETH will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your access to or use of (or inability to use) the Site or Services, even if ELVIS OF NAZARETH has been advised of the possibility of such damages.
You understand and agree that you use the Site and participate in any Services at your own risk.
10) Changes, Access Restrictions, and Service Availability
ELVIS OF NAZARETH may change, restrict access to, suspend, or discontinue the Site or any part of it at any time.
11) Intellectual Property
All rights, title, and interest in and to the Site and Services, including all related intellectual property rights, are owned by ELVIS OF NAZARETH or its licensors. Except as expressly permitted by this Agreement, you do not acquire any rights in the Site or Services.
You agree not to modify, adapt, translate, create derivative works from, decompile, reverse engineer, disassemble, or otherwise attempt to derive source code from any software or technology used to provide the Services, and not to create or attempt to create a substitute or similar service or product using ELVIS OF NAZARETH proprietary information.
12) Confidentiality
You agree not to disclose or misuse information obtained from ELVIS OF NAZARETH or from ELVIS OF NAZARETH clients, advertisers, suppliers, or forum members.
Information submitted by end users in connection with the Site or Services may be considered proprietary and confidential to ELVIS OF NAZARETH and may not be reproduced, disseminated, sold, distributed, or commercially exploited.
13) Non-Assignment
You may not assign or transfer any rights or obligations under this Agreement without ELVIS OF NAZARETH prior written consent. Any attempted assignment in violation of this section may result in termination of this Agreement.
ELVIS OF NAZARETH may assign this Agreement at any time without notice.
14) Waiver
Failure by ELVIS OF NAZARETH to enforce any provision of this Agreement will not constitute a waiver of that provision or any other provision, nor will it waive ELVIS OF NAZARETH right to enforce the provision at a later time.
15) Severability
If any provision of this Agreement is held unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
16) Entire Agreement
This Agreement constitutes the entire agreement between you and ELVIS OF NAZARETH regarding your use of the Site and Services and supersedes all prior or contemporaneous communications, understandings, or agreements.
17) Governing Law; Jurisdiction; Forum
This Agreement is governed by the substantive laws of the State of Georgia, without regard to conflict-of-laws principles.
Any dispute, controversy, or claim arising out of or relating to this Agreement, the Site, or the Services is irrevocably submitted to the exclusive jurisdiction of the state and federal courts located in Georgia, and you waive any objections to venue in those courts.
